1. Contract for education and training
The contract for the provision of education and training between the driving school Jana Fröhlichová - driving school BLIK ID:71559477 (hereinafter referred to as the driving school) and the applicant for a driving license (hereinafter referred to as the applicant) is concluded in accordance with Act 89/2013 Coll., the Civil Code and Act 247/2000 Coll., on the acquisition and improvement of the ability to drive motor vehicles, as amended.
The conclusion of the contract means the submission of a signed application for a driving license, a medical certificate of medical fitness to drive motor vehicles certified by a doctor, payment of the course fee, or part of it in the case of a course fee in installments, and enrollment in the instruction and training.
The driving school undertakes, on the basis of the contract thus concluded, to provide the applicant with theoretical instruction and practical training to obtain a driving license and to further ensure that the applicant holds a final professional competence exam. The course of instruction, training and examination is governed by Act 247/2000 Coll., as amended. The content of the instruction and training is governed by Implementing Decree No. 167/2002 Coll. (hereinafter referred to as the "Decree").
2. Conditions for admission to education and training
The driving school operator will admit a person to education and training to obtain a driving license who submits a written application:
on the date of completion of education and training, the person reaches the age prescribed for granting a driving license of the relevant group according to a special law, and no more than 18 months may elapse from the start of education and training to their completion.
the person is not incapacitated for legal acts, is medically fit to drive a motor vehicle according to a special law
has permanent residence in the Czech Republic or temporary residence in the Czech Republic lasting at least 185 days, unless the person proves that he/she is preparing for the exercise of a profession in the Czech Republic for at least 6 months, is studying in the Czech Republic or meets other conditions if required by a special law for obtaining a driving license.
is not serving a sanction or punishment of a ban on activity consisting of a ban on driving motor vehicles.
The applicant, by concluding a contract, i.e. by submitting a properly completed application form, a medical report and paying the course fee or making the 1st deposit for the course fee, he confirms that he understands the business terms and conditions and the school rules of the driving school.
3. Conditions for cancellation of the trip
In the event of cancellation of the ordered date by the applicant, it is necessary to notify the driving school of this event no later than 24 hours before the agreed date. The date that is not properly observed and we are not informed about it within the above-mentioned time, will be forfeited to the applicant and a fee of CZK 800/90 minutes will be charged to cover the costs incurred.
4. Course fee
The amount of the course fee for individual types of training is regulated by the valid price list, located on the website www.autoskola-blik.cz.
When starting the course, the applicant is obliged to pay the course fee. After agreement with the driving school, the amount can be divided into several installments or, in cooperation with the driving school, the course financing from HOME CREDIT a.s., with which the driving school has a signed cooperation agreement, can be used. At the moment of payment of the course fee, the applicant is guaranteed a place in the course and a driving license applicant's card is issued, in which the teacher records participation in the training. Until the course fee or deposit is paid, neither practical nor theoretical instruction can be started.
The course fee can be paid in full or in several installments, with the lowest possible amount to be paid being CZK 3,000. The course fee can be paid in cash or by bank transfer to account no. 2201127066/2010. To identify the payment, the applicant must provide the student's name. If the applicant intends to finance the course from HOME CREDIT a.s., the driving school will generate and send a unique link via SMS to the applicant's phone number to arrange an online application for financing the course. The application is approved by the course financing provider, i.e. HOME CREDIT a.s.
The applicant will always be allowed to complete as many practical drives as they have currently paid for.
The course fee must be paid in full no later than two days before the final exam. If the course fee is not paid, the driving school reserves the right not to take the applicant to the final exam until the applicant fulfills his or her obligations to the driving school.
5. Withdrawal from the contract
Withdrawal from the contract is possible for both the applicant and the driving school. Notification of early termination of training must always be given to the other party in writing, preferably by e-mail. Withdrawal is considered legally effective on the day following the date of delivery of the written withdrawal from the contract.
In the event of early termination of training, an invoice for training and tuition will be made based on the documents submitted. If there is an overpayment when paying the course fee, the driving school will immediately return it to the applicant. If there is an underpayment, the applicant is obliged to immediately pay the course fee.
Upon request from the applicant, the driving school will issue a document on completed instruction and training within the agreed period, but no later than 10 days.
6. Withdrawal from the contract by the driving school
The driving school reserves the right not to start the training or not to continue the training that has already started if the applicant:
has lost his/her medical fitness to drive a motor vehicle
has been sentenced by an administrative authority or a court to a ban on driving a motor vehicle
during the training, he/she repeatedly violates the instructor's instructions in a particularly gross manner and thereby endangers road safety, the property of the driving school or the life and health of other road users
or has repeatedly (at least 3 times) failed to show up for the ordered practical training lesson without a proper excuse.
If the applicant is banned from driving a motor vehicle during the course, he/she is obliged to inform the driving school immediately. In such a case, the training is considered to have been terminated by the applicant.
7. Withdrawal from the contract by the applicant
The applicant has the right to withdraw from the contract without giving a reason.
In the event of early termination of instruction and training by the applicant, the driving school is entitled to reimbursement of the costs of the training provided and a contractual penalty in the amount specified in the current valid price list. The contractual penalty will be charged to the final billing of the course fee.
8. Abandonment of studies
If a period exceeding 3 months has passed since the last practice drive or since the end of theoretical instruction, in which the applicant has not ordered any practice drive from his instructor or from the driving school management, and the applicant has not requested the driving school to interrupt or postpone further training during this time, the driving school reserves the right to consider such action as abandonment of studies.
The termination of training will be carried out in accordance with the rules for withdrawal from the contract by the applicant.
9. Practice drives
A lesson lasts 45 minutes. A practice drive lasts 90 minutes (i.e. 2 teaching hours), unless the applicant and the instructor expressly agree otherwise.
The starting and ending points of the practice ride are determined by the instructor in agreement with the applicant.
The dates of the practice ride are determined by the instructor based on an agreement with the applicant. The instructor will inform the applicant of the date of the ride in writing and it is binding.
The applicant who has already ordered a practice ride and cannot attend must excuse the practice ride no later than 24 hours before the agreed date of the ride, and by SMS, WhatsApp message or telephone call to his instructor.
The contractual penalty for unexcused absence or failure of the ride by the applicant is stated in the current valid price list listed on the website www.autoskola-blik.cz, serves to cover the costs of the instructor's lost salary, and is payable before the start of the first following training lesson.
The applicant is obliged to arrive for the practice ride at the given time and at the agreed starting point. If the instructor and/or the applicant cannot, for example, arrive on time due to traffic conditions, they inform each other by phone or message immediately (at least 15 minutes before the agreed start of the ride).
If the applicant fails to arrive at the ordered practice ride without an excuse, the instructor is obliged to wait at the agreed place for 15 minutes, during which time he will try to contact the applicant by phone. After this time is exceeded, the ride is considered to have been aborted by the applicant. If the applicant arrives late, the agreed ride is shortened by the delay, unless the applicant and the instructor agree otherwise (depending on the instructor's time options).
If the instructor fails to arrive at the ordered ride without an excuse, the applicant is obliged to wait at the agreed place for 15 minutes, during which time he will try to contact the instructor by phone. If the applicant fails to contact the instructor within 15 minutes, the ride is considered to have been aborted by the instructor. Missed driving time caused by the driving school instructor will be compensated by a free extension of one of the following training lessons or by including an extraordinary replacement lesson.
The applicant undertakes to appear for the practice drive and the final exam in a state where his/her competence will not be excluded according to the applicable legal standards, e.g. by the consumption of alcohol, addictive substances, etc. In the event that the applicant causes damage to the driving school in a state that excludes the competence to drive a motor vehicle, he/she bears full responsibility for its compensation.
The applicant for a driving license is obliged to appear for the practice drive in sturdy shoes (strap shoes or shoes with a loose heel are excluded).
10. Final exams
The applicant will be presented for the final professional competence exam (hereinafter referred to as the exam) at the earliest.
